Limited Warranty and Disclaimer
Limited Warranty and Warranty Period
Malico Inc. offers a limited warranty on all of its products (“the Product”) against defects in materials and workmanship under the normal use for a period of twelve (12) months from the date of original purchase of the Product. To the extent that no claim is submitted within fourteen (14) days from the original purchase date, the specifications and quality of the Product shall be deemed fully accepted and recognized by the purchaser. In case of any warranty claim, proof of purchase (sales receipt) is required. If a material or workmanship defect arises with regards to the Product, and a valid claim is received within the warranty period, Malico Inc. Will either repair or replace the Product which has proven detective, at Malico Inc’s election. Malico Inc. reserve the right to provide substitute equivalent thereto. This limited warranty is not transferable and is extended solely to the original purchaser of the Product. Replacement or repaired the Product is warranted as above only for the remainder of the original applicable warranty period.
Disclaimer
Except for the limited warranty expressly set forth herein, Malico Inc. expressly disclaims any and all other warranties express or implied, including any warranty of quality, merchantability, or fitness for a particular purpose. In no event shall Malico Inc. be liable to anyone for any incidental or consequential damages with regard to the Product. The maximum liability of Malico Inc. under this warranty shall not exceed the actual purchase price paid for the Product which has proven detective. This Limited Warranty does not extend to any damage, deterioration, malfunction, failure, or injury caused by or resulting from: (a) any alteration, modification, improper or unreasonable use, repair or maintenance, misuse, abuse, accident, neglect; (b) any operation/installation not made in strict accordance with the specifications and written instructions provided by Malico Inc.; (c) use of the Product for any purpose other than those for which it was designed; (d) ordinary wear and tear; (e) disasters or Acts of God; and/or (f) the misuse or failure of any item or equipment (not supplied by Malico Inc.) connected to the Product. In addition, this limited warranty does not extend to any damage, deterioration, malfunction, failure, or injury caused by or resulting from the Product incorporated in any kind of system/assembly (not supplied by Enzotech Corp.) or any kind of system/assembly (not supplied by Malico Inc.) incorporated with the Product, and/or any other reason or event not caused by Malico Inc. |
